PENGAKHIRAN HUBUNGAN KERJA SECARA SEPIHAK OLEH L-STORE TERHADAP HOST LIVE STREAMING BERDASARKAN UNDANG-UNDANG KETENAGAKERJAAN

Abstrak

The rapid expansion of the digital economy has generated various forms of employment through digital platforms, including the profession of live streaming host. One business entity implementing this employment model is L-Store, which establishes employment relationships through a job offer letter serving as the basis for a Fixed Term Employment Agreement (PKWT). Despite the existence of a valid PKWT, L-Store unilaterally terminated the employment relationship before the agreed contractual period expired. The termination was carried out without providing compensation or damages as required under Indonesian labor regulations. This study applies the theory of employment relationships and the labor protection theory proposed by Iman Soepomo. It adopts a normative empirical legal research method using statutory and conceptual approaches. Research data were collected through interviews, observations, documentation, and literature review, followed by qualitative descriptive analysis. The findings indicate that the job offer letter issued by L-Store fulfills the essential elements of employment, wages, and employer authority, thereby qualifying as a legally valid PKWT. However, the termination of employment before the expiration of the contract was not supported by legally recognized grounds under the applicable labor legislation. Consequently, L-Store was legally obligated to provide compensation and damages arising from the premature termination of the PKWT, yet these obligations remained unfulfilled. Legal protection for workers depends on employers' compliance with labor regulations and workers' awareness of their statutory rights, enabling them to pursue and defend those rights through available legal mechanisms.
